What is a blind watchmaker?
It is a concept developed by Darwin on evolution, a blind watchmaker who tinkered without knowing whether the mutation done to a given organism had any type of significance in the future. Whether it was possible for the mutation to give or not an advantage.
In almost the same sense, I think of the ILC (International Law Commission) as blind watchmakers of international law. They keep having an agenda. They keep tinkering. Some issues might have great significance, and others will not. Ultimately, work, even if it aims to advance the systematization of international law, they don’t know whether work will have any positive or negative outcome or ultimately if it will resonate in the larger community of international law.
They don’t know. There is hope that such systematization takes us to a better step in the evolution of international law. Further innovations mean further modifications in international law. The progressive development of international law entails the idea that international law is not settled. And the work made by the ILC to develop new areas of international law means that the ILC is pushing to some better peaks of the evolution of international law.
Where are those peaks of the evolutionary path of international law? Nobody knows. We might have an idea or an ideal for those peaks, and pushing towards such peaks of evolution to a fitter landscape
